Terms of Service

By accessing or using the Irongate Networks website ("Site") and services ("Services"), you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Site.

Irongate Networks provides network security services including but not limited to:

• Security consulting and assessments
• Security architecture design and implementation
• Managed security services
• Incident response and forensics
• Threat intelligence and monitoring
• Security operations center (SOC) services

Specific service terms are outlined in separate Service Agreements executed between Irongate Networks and clients.

3.1 Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe intellectual property rights
• Transmit malicious code or viruses
• Attempt unauthorized access to our systems
• Interfere with or disrupt services
• Impersonate others or misrepresent affiliation

3.2 Account Security

If you create an account, you are responsible for maintaining account confidentiality and all activities under your account. Notify us immediately of unauthorized access.

The Site and Services, including all content, features, and functionality, are owned by Irongate Networks and protected by Australian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content without prior written permission.

Trademarks, service marks, and logos displayed on the Site are the property of Irongate Networks or third parties. Use of these marks without permission is prohibited.

Specific security services are governed by separate Service Agreements executed between Irongate Networks and clients. Service Agreements include:

• Scope of work and deliverables
• Fees and payment terms
• Confidentiality obligations
• Liability limitations
• Service level agreements (SLAs)
• Termination conditions

In case of conflict between these Terms and a Service Agreement, the Service Agreement prevails for enrolled clients.

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Irongate Networks disclaims all warranties including but not limited to:

• Merchantability and fitness for particular purpose
• Non-infringement of third-party rights
• Accuracy, completeness, or reliability of content
• Uninterrupted or error-free operation
• Security or absence of viruses or harmful components

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONGATE NETWORKS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Unauthorized access to or alteration of your data
• Third-party conduct or content on the Services
• Any matter beyond our reasonable control

Our total liability for any claims arising from these Terms or the Services shall not exceed the amount paid by you to Irongate Networks in the twelve months preceding the claim.

Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, right, or remedy implied or imposed by law which cannot lawfully be excluded or limited.

You agree to indemnify, defend, and hold harmless Irongate Networks, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your use of Services, violation of these Terms, or infringement of any rights of another.

We may terminate or suspend your access to Services immediately, without prior notice or liability, for any reason including breach of these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.

Any disputes arising from these Terms or use of Services shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of Services after changes constitutes acceptance of modified Terms.
